Holzhouser NOTICE OF FORECLOSURE SALE WHEREAS, by Deed of Trust (the ''Deed of Trust'') dated February 6, 2006, of record at Record Book 444, page 914, Register's Office for Marshall County, Tennessee, TOM HOLZHAUSER, a single person, did convey unto MICHAEL A. RITTENBERRY , as Trustee, a certain tract of real estate hereinafter described, to secure a certain indebtedness set out in said Deed of Trust; and WHEREAS, PEOPLES BANK OF MIDDLE TENNESSEE f/k/a Peoples Bank of Bedford County is the owner and holder of the note secured by said Deed of Trust hereinabove referred to; and WHEREAS, the said Michael A. Rittenberry, Trustee, is unable to act as Trustee under the Deed of Trust and I have been appointed Substitute Trustee by the owner and holder of the note by instrument of record at Record Book 702, page 144, Register’s Office for Marshall County, Tennessee; and WHEREAS, the said real estate described in said Deed of Trust is as follows: Located in the Second (2nd) Civil District of Marshall County, Tennessee: Beginning at an iron pin on the north margin of U.S. Hwy. 31-A in line with a fence from the north at the southwest corner of the William Chest, et ux, property and the southeast corner of the Garnetta W. Hensley property of which the herein described tract is a portion; thence with the margin of the highway South 56 degrees 39 minutes West 266.21 feet to an iron pin at a fence corner; thence leaving the margin of the highway North 20 degrees 51 minutes West 271.86 feet to an iron pin at a fence post; thence South 59 degrees 36 minutes West 336.14 feet to an iron pin at a fence post in the north line of the Randall T. Holder, et ux, property in Dalton’s east line; thence with Holder’s south line North 80 degrees 20 minutes East 536.24 feet to an iron pin in line with a fence from the north at Holder’s southeast corner; thence with Holder’s east line North 0 degrees 14 minutes East 161.56 feet to an iron pin on the south margin of Old Farmington Road at Holder’s northeast corner; thence with the south margin of the road North 81 degrees 00 minutes East 365.98 feet to an iron pin at a fence corner at the northwest corner of the Lester G. West, et ux, property and the northeast corner of the herein described tract; thence with the west line of West and the William Chest property South 1 degree 49 minutes West 667.29 feet to the point of beginning, containing 10.25 acres, more or less. THERE IS FURTHER CONVEYED a 1992 Franklin Rockwood mobile home, Serial Numbers ALFRA 1806388A and ALFRA 1806388B, located on the above-described premises. Being the same property conveyed to Tom Holzhauser by Warranty Deed from Bobby Bruce Hankins and wife, Judith H. Hankins, dated August 13, 1999, of record at Record Book 269, page 521, Register’s Office of Marshall County, Tennessee. This conveyance is subject to any and all other existing easements and restrictions of record. WHEREAS, said Deed of Trust was made to secure the payment of a note therein set out and contained the power to sell in the case of default in the payment of said note and interest at maturity; and WHEREAS, the maker of said note has defaulted in the payment thereof, and the owner and holder of said note has declared the entire amount due and payable and has requested the undersigned to foreclose said Deed of Trust according to its terms in order to collect said note. NOW, THEREFORE, I, the undersigned JOE M. LAMBERT, JR., Substitute Trustee, will, in accordance with the terms set out in the Deed of Trust above referred to, on Wednesday, May 22, 2019, at 10:00 a.m., at the front door of the Marshall County Courthouse in Lewisburg, Tennessee, offer for sale and sell the above-described real estate at public auction to the highest and best bidder for cash in bar of equity of redemption and free from homestead and dower, all in accordance with the provisions of said Deed of Trust and the laws of Tennessee controlling such sales, subject, however, to all outstanding real estate taxes. S. C. § 7425 and T. C. A. § 67-1-1433. The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U. S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the holder of the Deed of Trust.
