Prosecutor moving to Chattanooga; successor sought

The assistant district attorney prosecuting drunken driving cases in Marshall, Bedford, Lincoln and Moore counties has accepted a job with the Hamilton County District Attorney General's office in Chattanooga.

Kate Lavery said the transfer is beneficial to her because of family and friends who are closer to Chattanooga than the 17th Judicial District. Lavery began prosecuting cases here more than a year ago. Her position is paid by a state grant to assure prosecution of DUI cases.

Most are concluded at the General Sessions Court level, but some, such as charges against Mark Wilkerson, a member of the Marshall County School Board, are fought in Circuit Court. Now, Assistant District Attorney Eddie Barnard or District Attorney Chuck Crawford are prosecuting the case.

Lavery was to continue working through September, Crawford said.

"We have begun the interview process," he said late last week. "We have interviews scheduled."

"We would like to have the right person in place as soon as possible," he said.
